OBAVEZNA IMUNIZACIJA ZAPOSLENIH − NUŽNA MERA U VREME PANDEMIJE ILI NEOPRAVDANA DEROGACIJA RADNIH PRAVA?
Apstrakt
Pandemija izazvana virusom SARS-COV-2 dovela je u pitanje živote i zdravlje ljudi širom sveta. Pandemija je otvorila i brojna pitanja u sferi radnih odnosa. I poslodavci i zaposleni su (nespremni) stavljeni pred brojne izazove organizovanja rada u vanrednim okolnostima. Stoga ne čudi to što je, usled dostupnosti vakcina, i pitanje imunizacije zaposlenih zadobilo poseban značaj. Naglašavajući da smatra da treba podsticati zaposlene da se vakcinišu, autorka postavlja hipotezu da bi, u skladu sa radnopravnim okvirom u Srbiji, otkaz dat zaposlenom usled odbijanja da se vakciniše, bio nezakonit. Hipoteza je zasnovana na dva ključna argumenta koja se odnose na (ne)opravdane razloge poslodavca za otkaz ugovora o radu i mogućnost rada van prostorija poslodavca. Ipak, nova saznanja, dalji razvoj događaja i potencijalne izmene radnog zakonodavstva mogu biti snažan podsticaj za preispitivanje svake hipoteze o pitanju obavezne imunizacije i prava iz radnog odnosa.
