VENECIJANSKA KOMISIJA I USTAVNO SUDSTVO
Apstrakt
Evropska komisija za demokratiju kroz pravo, poznatija kao Venecijanska komisija je savetodavno telo pri Savetu Evrope. Primarni način delovanja Venecijanske komisije je izdavanje mišljenja o ustavnim odredbama i drugim pravnim normama kako na sopstvenu inicijativu, tako i na zahteve institucija koje su ovlašćene da zatraže mišljenje Komisije, a u svrhu asistiranja u materiji ustavnog prava, zasnivajući se na osnovnim načelima evropske ustavotvorne tradicije, i to na načelu poštovanja ljudskih prava, načelu demokratije i načelu pravne države i vladavine prava.2 U okviru svojih delatnosti, Venecijanska komisija priprema raznovrsne studije, te amicus curiae mišljenja i sl. U prvom delu se autor bavi organizacijom Venecijanske komisije i njenim položajem u institucionalnom okviru Saveta Evrope. Centralna tema rada jeste delovanje Venecijanske komisije u materiji koja se konkretno tiče ustavnog sudstva, što obuhvata mehanizme delovanja Komisije i odnos država prema njenim mišljenjima u ovoj materiji, posmatran kroz način na koji se mišljenja (ne) primenjuju u nacionalnim zakonodavstvima u zavisnosti od prisustva, odnosno odsustva spoljnih uticaja. Autor se posebno osvrće na delovanje Venecijanske komisije u ustavnoj krizi u Poljskoj započetu u leto 2015. godine.
